Copyright Policy (India)
This policy explains how my1campus addresses copyright issues in India, including reporting procedures, counter notices, and measures we may take. It aligns with the Copyright Act, 1957 (as amended), the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules 2021).
1) Applicable Indian laws
- Copyright Act, 1957 (including amendments).
- Information Technology Act, 2000 (including Section 79 safe harbour).
- IT Rules 2021, including due diligence obligations for intermediaries.
2) Our role as an intermediary
my1campus enables users to upload and access study materials. We do not pre-screen all content. As an “intermediary” under the IT Act, we follow due diligence requirements and act upon obtaining actual knowledge of unlawful content through a court order or notification from appropriate government/agencies, or a sufficiently detailed rights-holder notice as described below.
3) Ownership and permitted use
- Upload only content you own or are authorized to share.
- Do not upload entire books, paid materials, or exams without permission.
- Educational fair dealing exceptions may apply under Indian law, but you are responsible for compliance.
4) How to submit a copyright notice (India)
To help us act promptly, include:
- Your full name, postal address, and a reachable email address.
- Identification of the work claimed to be infringed and proof of ownership (e.g., registration number, if any).
- Exact location of the allegedly infringing content on my1campus (full URL).
- Description of how the content infringes your rights.
- A good-faith statement that the information is accurate and you are authorized to act for the rightsholder.
- Your physical or electronic signature.
Send notices to our Grievance Officer (India) via support@my1campus.app. We may request additional information to verify your claim before taking action.
5) Our process after your notice
- We assess whether the notice is sufficiently precise and adequately substantiated.
- Where appropriate, we may remove or disable access to the reported content.
- We may notify the uploader and seek their response and/or evidence of authorization.
- We may preserve relevant records to support investigations or dispute resolution.
6) Counter notice (if your content was removed)
Include:
- Your name, contact details, and account identifier.
- Links/URLs to the removed content and why the removal was incorrect (e.g., license, ownership, or fair dealing).
- Any supporting documents (e.g., permission letters, licenses).
Send to support@my1campus.app. We will review and may reinstate content where appropriate.
7) Measures we may take
- Remove/disable access to specific content.
- Warn users and limit features (e.g., uploads).
- Suspend or terminate accounts in serious or repeated cases.
- Where legally required, report serious unlawful activity to authorities.
8) Repeat infringers policy
Users who repeatedly infringe rights or violate our Terms may face feature restrictions, suspension, or termination. We may also restrict reporting access for those who submit manifestly unfounded or abusive notices.
9) Data handling and privacy
We process personal data in notices and counter notices only to handle your request, comply with legal obligations, and prevent abuse. See our Privacy Policy for details. We may share the substance of a notice with the uploader to allow a meaningful response, unless prohibited by law.
10) Disclaimer and jurisdiction
